Terms and Conditions
Contracted package
Includes all services described in selected package details reviewed and distributed to clients. Any additional services/products requested by the client incurred by consultant will be billed directly to client. All services contracted cannot be deducted, but additional services can be added.
Cleanliness
In preparing the luxury picnic experience set-up, the Consultant handles all items with the highest cleanliness and health standards.
Liability
It is understood that Consultant is only liable for services completed and provided by Consultant and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Consultant be liable for consequential damages of any kind.
Cancellation Policy & Deposit
If the reservation is cancelled over 48 hours in advance of the reservation, 50% of the entire payment (minus the $50 non-refundable deposit) will be refunded. The remaining amount may be credited toward a future reservation. If the reservation is cancelled less than 48 hours but more than 24 hours before the reservation, there will be no refund and a 25% credit toward a future reservation. Should a reservation be cancelled less than 24 hours prior to the reservation, there will be no refund and no credits.
In order to setup, there must not be any wind (in excess of 15mph gusts), rain, or precipitation coming down during the set-up or rental. Should inclement weather appear to be a concern, we will stay in touch in the days before your reservation and make a final call 12 hours prior to your reservation time. If it is impossible to set up outdoors, we can move the experience inside or postpone to another available date.
Cold Weather Policy
CoMo Picnics will offer cold weather picnics utilizing heated bubble tents when air temperatures are between 20℉ and 55℉ at the time of the picnic. Winds must be under 15mph and accumulating snow is not allowed to operate tented picnics. Should either high winds be predicted, accumulating snow expected or under 20℉ predicted, picnics will be canceled by CoMo Picnics 72 hours ahead of the scheduled picnic time. Guests will be offered rescheduling options, credit for a future picnic (within 6 months) or a full refund (minus the $50 non-refundable fee). The safety and enjoyment of our guests is just as important as the safety of our staff in creating these experiences.
Responsibility
Consultant is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the consultant, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance. In such a situation, consultant will obtain, upon approval of the client, a qualified professional replacement to fulfill consultant’s obligations under the contract, at no additional charge to the client.
Additional Rental
Due to the schedule for luxury picnic experiences there will not be any time extension offered outside the two-hour rental period unless agreed upon and billed.
Contracted Vendor and Payments
Any rentals and/or subcontracted vendors contracted on behalf of client (outside of the pre-established package) will be paid in full to Consultant directly at requested deadline. Proper notice will be provided per cost.
Damage or Loss of Accessories
Client must text/call CoMo Picnics 15-20 minutes before their departure. Client will be liable to any damage to the unattended picnic. Prior to leaving, candles must be snuffed and any heater/lights be turned off. CoMo Picnics will return to take down the luxury picnic experience. All items should be left on the table for ease of pick-up. All décor items will be packed and organized by the Consultant and staff.
Client agrees to exercise all due care in caring for, and preserving the property of Consultant. Clients shall remain responsible for all loss or damage to rentals, up to and including actual replacement value for each missing or damaged item per cost. We ask that client's be upfront and honest as we want to work hard to make all rental experiences a success. Activities (ie painting) that have a tendency to be messy should be done off of the set-up or the ground covered to ensure the rental does not get soiled.
Attorney
If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in additional to any other remedies to which that party might be legally entitled.
Appropriate Conduct/ Safe Working Environment:
The Client(s) expressly agree(s) to take best efforts to provide [Provider] and Provider's staff with a safe and appropriate professional relationship. In the event of circumstances deemed to present a threat or implied threat of injury or unprofessional, harassing language or behavior to [Provider] staff, [Provider] will make reasonable efforts to notify the Client(s). If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time, [Provider] shall resume work in accordance with the original terms of this Agreement. If the inappropriate behavior continues, the Client(s) will agree to relieve and hold [Provider] harmless as a result of incomplete services under this Agreement, or for a lapse in the quality of the [Provider]work. The Client(s) shall be responsible for payment in full, regardless of whether the situation is resolved or whether [Provider] resumes work detailed in this Agreement.
The undersigned have read this contract, understand its terms, and agree to be bound thereby. Any additions, deletions, or revisions must be made in writing and approved by all responsible parties. The parties agree that this contract is the complete and exclusive statement of the mutual understanding of the parties.
